Abuse, Fraud & Legal Policy

Abuse, Fraud & Policy Misuse

  • Digimate reserves the right to decline or restrict returns in cases of excessive, suspicious, or abusive return behavior.
  • Any misuse of this Policy may result in order cancellation, account suspension, or refusal of service.
  • Fraudulent claims or unjustified chargebacks may be legally contested.
  • Digimate reserves the absolute right to refuse, deny, or cancel any return, replacement, or refund request in cases where the customer uses abusive, threatening, defamatory, obscene, or vulgar language in any form of communication, including emails, calls, chats, social media, or support tickets.
  • Such conduct shall be treated as misuse of the Buyer Protection Policy and may result in order cancellation, account suspension, or permanent restriction of services, without prejudice to Digimate’s other legal rights and remedies.

Force Majeure

Digimate shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, strikes, lockdowns, courier disruptions, or governmental restrictions.

Governing Law & Dispute Resolution (Arbitration)

  • This Policy shall be governed by and construed in accordance with the laws of India.
  • All disputes arising out of or relating to this Policy or any purchase made on Digimate shall be resolved through arbitration under the Arbitration and Conciliation Act, 1996, as amended.
  • The arbitration shall be conducted by a sole arbitrator appointed by Digimate.
  • The seat and venue of arbitration shall be Delhi, India.
  • The arbitration proceedings shall be conducted in the English language.
  • The arbitral award shall be final and binding on the parties.
  • Notwithstanding the above, Digimate reserves the right to seek interim or injunctive relief from a court of competent jurisdiction.

Policy Amendments

Digimate reserves the right to modify, update, or amend this Policy at any time without prior notice. Continued use of the website constitutes acceptance of the revised Policy.

Deemed Acceptance & Binding Effect

By accessing, browsing, or using the Digimate website and/or placing an order, the user expressly agrees to be bound by this Buyer Protection Policy.

Such access or use shall be deemed to constitute lawful acceptance of this Policy under applicable Indian laws, including the Indian Contract Act, 1872, the Information Technology Act, 2000, and the Consumer Protection Act, 2019. If a user does not agree with any part of this Policy, the user must refrain from using the website or making any purchase.
